Environmental Restrictions: What You Need to Know

Bacalar's regulations are stricter than most Mexican coastal markets. Understanding them before you buy is not optional — violations result in demolition orders.

  • ZOFEMAT setback: The federal maritime zone (ZOFEMAT) applies to the lagoon shoreline. Typically 3–10m from the mean high waterline cannot be built on. Verify the exact setback on any lot before contracting.
  • State ecological setback: An additional 10–30m buffer zone from the lagoon edge is commonly imposed by Quintana Roo state regulations. Total restricted band from water's edge can reach 40m on some parcels.
  • No conventional sewage: All construction must use certified biological wastewater treatment systems (biodigestores). Monthly maintenance is required and inspected.
  • Height limits: Most shoreline zones restrict structures to 6–8m height. No high-rise construction is permitted near the lagoon perimeter.
  • SEMARNAT permit: Any construction within the lagoon's ecological buffer zone requires environmental impact authorization from SEMARNAT. Factor 60–120 additional days into your construction timeline.
